Abstract

In order to reduce the number of Positiv Covid-19 patients, the Government, as stipulated in Article 13a paragraph (4) of Presidential Decree 14 of 2021 imposes fine sanctions. The imposition of this fine certainly raises pros and cons so that it is interesting to discuss in the empirical juridical study carried out in the city of Semarang. The results show that this Presidential Regulation violates human rights, especially the definition of a public health emergency itself which needs to be reviewed because the definition does not yet have a standard of what can be categorized as a public health emergency and its enforcement will be difficult because based on the author's research, as many as 55% of respondents in Semarang city rejects the idea of a fine, so it is necessary to consider alternative ways such as in Australia where the government provides incentives to persuade people to join the vaccine program.
